In this essay I first provide a brief explanation of the principle of double effect (PDE) and the propositions that it entails regarding the distinction betweenintention and foresight (I/F distinction) and the distinction’s relevance to ethical evaluation. Then I address several recent critiques of PDE and the I/F distinctionby influential ethicists including Judith Jarvis Thomson, Tom Beauchamp and James Childress, and Jonathan Bennett. I argue that none of these critiques issuccessful. In the process of refuting the critiques, I also give (...) prima facie reason to believe that the I/F distinction is relevant to evaluation of agents and their actions and that PDE is a defensible ethical principle. Claims regarding collective or group mental states are fairly commonplace: we speak of things like the belief of the Church, the will of the faculty, and the opinion of the Supreme Court, often without considering what such claims really mean and whether they are true in any interesting sense. In this paper I take a threefold approach: first, I articulate several ways in which a group might be said to have beliefs and other mental states. Second, I explore the implications, (...) positive and negative, of these accounts of collective mental states. Third, I give a brief defense of my own view despite its somewhat disturbing implications for our membership in Church, State, and other groups. (shrink)

According to H. M. Giebel, at least three difficulties arise for my view of intention, foresight, and mutilation. First, I must either give up my account of the intention/foresight distinction or conclude that obstetric craniotomy does not constitute mutilation. Secondly, my account of the intention/foresight distinction leads to counter-intuitive conclusions such as that surgical sterilization is impermissible but removal of non-functioning limbs against the will of the possessor is morally permissible. Thirdly, she suggests that my account of mutilation is (...) incomplete for it rests on an understanding of “health” that is not adequately specified. In this paper, I argue that my original accounts of both the intention/foresight distinction and mutilation can, nevertheless, still be defended. (shrink)

Commentators are divided on the interpretation of Metaphysics Z4 1029b13–22. For one thing, it is unclear whether the passage rejects a claim about the essence of surface, or about the essence of pale. It is usually thought that the claim is disavowed because it involves a circular definition. However, this is conjectural, since Aristotle does not explicitly say anything about circularity in the lines in question. I argue here for an alternative account, which reads the disputed lines as an extension (...) of the immediately preceding remarks. If correct, this also solves the problem as to just what Aristotle is denying. As will emerge, my story is helped by St. Thomas’ reading of lines 21–22, an account that has been curiously ignored in the recent literature. (shrink)

It has been claimed that the earliest expression of a robust scepticism is in the Catalogue of Ships in the Iliad, and even commentators who would not go that far have thought the passage an important guide to epistemological attitudes in Homeric antiquity. It will be argued here that a close examination of the text does not support such conclusions. On the other hand, there are respectable reasons for an interpretation in which religious factors are operative, rather than epistemic ones. (...) Introduction - This paper is aimed at gaining more insight into the effects of camera-surveillance on behavior. This study investigates the effects of three different ways of ‘framing’ camera presence on cheating behavior and pro-social behavior. First, we explore the effect of presenting the camera as the medium through which an intimidating authority watches the participant. Second, we test the effect of presenting the camera as being a neutral, non-intimidating viewer. Third, we investigate whether a participant watching themselves via a (...) camera has an effect on their behavior. In contrast to most studies of camera surveillance, we will conduct our experiments in an indoor setting, enabling us to investigate behavior to a much greater detail. We will also explore possible moderating effects of personality traits. Methods - 86 students participated in this experiment, distributed over four conditions: three different ways of framing the camera presence, plus a control condition. Our main dependent variables were various kinds of cheating and pro-social behavior. We established the participant’s relevant personality traits in a separate session. Results - For cheating behavior, findings showed that the ‘authorative’ way of framing camera presence and the situation in which participants viewed themselves, differed significantly from a situation without camera-surveillance. We did not find significant effects of camera surveillance on pro-social behavior during the experiment. Looking at personality traits, we found an indication that people with an internal locus of control are more inclined to cheat when there is no camera present compared to people with an external locus of control. However, the effects of our manipulations were stronger. Conclusion - These results support the idea that the framing of a camera’s presence does indeed influence cheating behavior, adding to the preventive effects of camera-surveillance. Additionally, this study provides some valuable insights into the influence of camera presence on behavior in general. (shrink)

Institutional theory of law (ITL) reflects both continuity and change of Kelsen's legal positivism. The main alteration results from the way ITL extends Hart's linguistic turn towards ordinary language philosophy (OLP). Hart holds –like Kelsen – that law cannot be reduced to brute fact nor morality, but because of its attempt to reconstruct social practices his theory is more inclusive. By introducing the notion of law as an extra-linguistic institution ITL takes a next step in legal positivism and accounts for (...) the relationship between action and validity within the legal system. There are, however, some problems yet unresolved by ITL. One of them is its theory of meaning. An other is the way it accounts for change and development. Answers may be based on the pragmatic philosophy of Charles Sanders Peirce, who emphasises the intrinsic relation between the meaning of speech acts and the process of habit formation. (shrink)
